Aims and Objectives:

To provide an overview of the complex relationship between professional ethics, the application of the law and the impact of social policy. 

  • Understand your responsibilities as a social worker to the service user, the family and    the Court.
  • Understand the need to work in a multi-agency forum.
  • Understand the key principles of the Children Act 1989 and how they apply in everyday social work decision making.
  • Understand the interaction of human rights.
  • Be familiar with how the law, including case law, can support children and families and care planning.
  • Understand the range of powers and impact for children who are after children whilst in care and when leaving care.
  • Understand the court process and the need for planning for Care proceedings, the pre-proceedings stage and available permanency options

  • Responsibilities as a social worker and interaction with the law 
  • What are your responsibilities as a social worker to the child, professionals, the family, and the multi-agency forum.
  • Practicalities of seeking legal advice and developing an effective working and supportive relationship with the LA’s legal representative
  • Main Principles of Children Act 1989
  • Local Authority statutory powers and duties to Children S.17, S.47 Children Act
  • Public Law proceedings and orders- S.31 Children Act
  • Public Law Outline- overview of the process and statutory timescales
  • There is a need for concurrent care planning and considering realistic plans for the child’s permanency.
  • Leaving Care Services- Leaving Care Act
